When an amparo applies

  • Denial of medication, treatment, surgery or a medical procedure
  • Unjustified delays in care
  • Denial of a transfer to a specialized hospital
  • Failure to provide prescribed supplies or studies

Why the amparo is effective

The right to health is protected by the Constitution and international treaties. Courts have repeatedly ordered institutions to provide necessary treatment. When there is a risk of irreversible harm, the judge can order a provisional measure while the case is decided.

How the process works

  • Urgent review: we check the medical prescription, the denial and the urgency
  • Filing: the indirect amparo is filed against the responsible authority
  • Suspension: where the risk is urgent, a suspension or provisional measure is requested
  • Hearing and judgment: the court orders the institution to act

What you need

  • Medical prescription or treatment indication
  • The denial, in writing if possible (or a record of the refusal)
  • Medical records and diagnosis
  • ID and proof of affiliation to the institution

What if there is no written denial?

The refusal can be documented with messages, receipts, witness testimony or a follow-up request to the institution. Our team helps build that record.

Frequent questions

Does it work against a private hospital? It can, when the provider is subject to the amparo jurisdiction or when the refusal violates a legal obligation.

Can it be filed urgently? Yes. Urgent cases can request a provisional measure at the same time as the amparo.
