What is uncontested divorce?
Under the Civil Code of Coahuila, a marriage can be dissolved at the request of either spouse without proving a cause. It is called divorcio incausado: neither party has to accuse the other or explain why the marriage ended. The court verifies the legal requirements and issues the judgment.
When does it apply?
- The marriage is registered in Coahuila, or the last marital domicile is in Coahuila
- At least one spouse wants to end the marriage
- There are no legal impediments (for example, a previous marriage not yet dissolved)
How the process works
- Filing: we file the petition with a proposed agreement on custody, support and assets, when possible
- Admission and notice: the court admits the petition and notifies the other spouse
- Answer and hearing: if there is no agreement, the court sets a hearing and receives evidence
- Judgment: the court dissolves the marriage and rules on the effects
- Registration: the judgment is registered with the Civil Registry
What happens with children and assets?
The court decides custody and support based on the best interest of the children. Marital property is divided according to the regime chosen at marriage (society or separation of property). Compensation may be claimed when one spouse dedicated time to the household or the family business.
What you need
- Marriage certificate (recent copy)
- Official identification of both spouses
- Birth certificates of the children, when applicable
- Proof of address
- Income and asset documents, when relevant
Frequent questions
Do I need my spouse's consent? No. Uncontested divorce can be filed by one spouse; the other is notified and has the right to answer.
How long does it take? An uncontested case typically takes three to six months; contested cases take longer because of evidence and hearings.
What if my spouse does not appear? The process continues and the court can issue a judgment in absentia, after verifying due notice.
